New York City is known for many things: its iconic skyline, its diverse culture, its vibrant nightlife. But it is also known for its high rents, its housing insecurity, and its neighborhood disruption caused by vacation rentals. That is why the city has enacted a new law that requires short-term rental operators to register their homes with the city or face fines of up to $1,000 per day.
The law, which went into effect on September 5, 2023, is meant to enforce older rules on short-term rentals that limit them to 30 days or less and require the host to be present during the stay. The law also aims to address the issues of high rents, housing insecurity, and neighborhood disruption caused by vacation rentals.
“This is a huge victory for every New Yorker who has ever had to deal with an illegal hotel in their building or on their block,” said Assemblymember Linda B. Rosenthal, who sponsored the bill that became the new law.
The law has had a significant impact on the Airbnb market in New York City, as data from Inside Airbnb, a housing advocacy group, shows a 70 percent drop in short-term listings on Airbnb between August 4 and September 5, the day the city began enforcing the new law. However, some short-term listings have been switched to long-term listings, which do not need to be registered, and there are still thousands of listings that could be unregistered.
“We’re seeing a massive exodus of hosts from Airbnb’s platform as a result of this law,” said Murray Cox, founder of Inside Airbnb.
The city has received more than 9,000 applications for short-term rental registration, but only about 2,000 have been reviewed, and only about 200 have been granted. More than 1,000 applications have been denied, and more than 700 have been returned for missing information or errors.
The registration process has been criticized by some hosts and guests as being complex and difficult, and lacking clarity and communication from the city and Airbnb.
“It’s not fair that they’re making us jump through all these hoops. It’s not like we’re running a hotel. We’re just sharing our home with travelers who want a local experience,” said David Lee, a host from Brooklyn who has been waiting for his registration approval for weeks.
“I had no idea this was happening. I booked this trip months ago. I’m supposed to fly out tomorrow. What am I supposed to do?” said Sarah Jones, a guest from California who had her booking canceled by her host two days before her arrival.
Airbnb has stated that it is continuing to work with New York City on implementing its new law and providing its community with clear guidance so they can continue to share their homes responsibly.

The new law is expected to have long-term effects on the Airbnb market in New York City, as well as on the city’s housing affordability and quality of life. Whether these effects will be positive or negative remains to be seen.
