    Generative AI: A New Frontier for Online Content and Legal Liability

    Generative AI is a technology that can create new content from user prompts. It has been increasingly integrated into our daily lives and work, powering systems like ChatGPT and Google Bard. However, it is also at the forefront of legal discussions concerning liability for online content.

    For the past decades, Section 230 of the Communications Decency Act has provided clear legal guidance regarding responsibility for most content on the Internet. It has immunized companies from litigation arising from most content appearing on their platforms, thereby enabling the expansion of the Internet worldwide.

    However, the application of these precedents to generative AI products is not straightforward. Unlike traditional online content, which is independently produced by platform users, generative AI products create new content in response to user prompts. This distinction raises questions about legal responsibility for content created by generative AI.

    In June 2023, a defamation suit was filed in Georgia state court against OpenAI, the makers of ChatGPT. The plaintiff, radio host Mark Walters, alleged that a journalist had used ChatGPT while researching a federal lawsuit. This case highlights the potential legal risks associated with generative AI and the need for clear legal guidance in this area.

    In response to these concerns, bipartisan legislation was introduced in the U.S. Senate in June 2023. The bill, introduced by Sens. Richard Blumenthal and Josh Hawley, aims to amend Section 230 of the Communications Decency Act with a clause that strips tech companies of immunity in cases involving the use of generative AI.

    This legislation would ensure that consumers have the tools they need to protect themselves from harmful content produced by the latest advancements in AI technology. It would also create a legal incentive for tech companies to monitor and moderate the use of generative AI products on their platforms.

    As the legal landscape surrounding generative AI continues to evolve, developers of generative AI systems are advised to proceed with caution when creating new products. The introduction of this legislation signals a significant shift in the legal landscape for online platforms offering generative AI products.
