In the escalating battle over immigration enforcement between the Biden administration and Texas officials, Democratic lawmakers are amplifying calls for President Joe Biden to take decisive action by federalizing the Texas National Guard. Governor Greg Abbott, who has been locked in a series of legal standoffs with the administration, has reinforced state border barriers and challenged the federal government’s authority over immigration policies.
Gov. Abbott openly accused President Biden of failing to uphold immigration laws and, in a bold move, declared Texas’s constitutional authority to defend itself against what he labels as an “invasion” by illegal migrants. The governor’s actions have prompted two House Democrats from Texas, Rep. Greg Casar and Rep. Joaquin Castro, to urge President Biden to assert federal control over the Texas National Guard to counteract Abbott’s measures. Casar, in particular, criticized Abbott for using “political stunts and inflammatory language” and insisted that if Abbott is disregarding the Supreme Court’s recent decision, “President Biden needs to establish sole federal control over the National Guard.”
The recent Supreme Court ruling has granted federal agents the right to remove razor-wire installed by Texas on the Mexico border, a move opposed by Abbott, who vowed not to “back down” from the state’s border efforts. This has led to a direct confrontation in areas such as Eagle Pass, where the Texas National Guard has fortified the area with additional razor-wire, despite federal demands for access. The Texas Military Department released a statement declaring their resolute actions to “secure our border, preserve the rule of law, and protect the sovereignty of our state.”
On the other side of the aisle, Republican lawmakers have rallied behind the governor’s stance. Rep. Chip Roy (R-Texas) called the Supreme Court decision “unconscionable,” suggesting that Texas should reject it outright, while Rep. Mike Collins (R-Ga.) introduced the RAZOR Act, aimed at preventing the federal government from interfering with state border barriers.
The calls for federal intervention are reminiscent of historical precedents, such as when President Eisenhower federalized the Arkansas National Guard in 1957 to enforce desegregation orders. Anthony Michael Kreis, a constitutional law expert, joined the chorus of voices by posting, “Joe Biden should respond to Greg Abbott by federalizing the Texas National Guard.”
The dispute underscores the larger conversation around the powers of federal versus state authority and the role of National Guard units. While ordinarily under the command of state governors, National Guards can be federalized under Title 10 status, which places them under the direct disposal of the president and the defense secretary, with active duty officers taking command. This mechanism was famously utilized during the Little Rock integration crisis.
With the tension continuing to mount, the Biden administration is now under increased scrutiny to act. Daniel Miller, president of the Texas Nationalist Movement (TNM), suggested that if the Texas National Guard is federalized, Texas should expand and militarize the Texas State Guard and deploy them to the southern border as a countermeasure.
