Trump Launches Appeal Against $454 Million Fraud Verdict as Legal Battles Mount

    Published on

Donald Trump has launched an appeal against a $454 million fraud judgment that found him and his company guilty of years of financial deceit. The notice of appeal, filed by Trump’s lawyers, challenges the ruling of New York State Judge Arthur Engoron, made on February 16 in response to a lawsuit brought by Attorney General Letitia James.

Trump’s attorneys filed court documents seeking the appeals court to determine if Engoron made legal and/or factual errors and if he exceeded his authority or “acted in excess” of his jurisdiction. The appeals process in New York begins with a notice of appeal. Trump’s lawyers will further detail their complaints in upcoming court submissions.

Judge Engoron’s findings established that Trump, along with top executives of his company, including his sons Eric and Donald Trump Jr., engaged in a years-long scheme to overstate Trump’s wealth on financial statements, used to secure loans and insurance policies. The judgment imposes stringent restrictions on the Trump Organization’s business dealings and, if upheld, could have significant financial repercussions for the former president and his company. Engoron ordered Trump to pay $355 million in penalties, a figure that with interest has swelled to nearly $454 million, and continues to accrue at a daily rate of nearly $112,000.

Trump said Engoron’s decision, the costliest consequence of his recent legal troubles, was “election interference” and “weaponization against a political opponent.” Trump complained he was being punished for “having built a perfect company, great cash, great buildings, great everything.”Trump’s attorney, Christopher Kise, expressed confidence that the appeals court will rectify the numerous errors made by a trial court detached from the law or reality.

Alina Habba, another of Trump’s lawyers, also reiterated this sentiment, stating, “Given the grave stakes, we trust that the Appellate Division will overturn this egregious verdict and end this relentless persecution against my clients.” Habba cautioned that if the decision stands, it will signal to Americans that “New York is no longer open for business.”

In addition to imposing monetary penalties, Engoron’s ruling prohibited Trump from running a corporation in New York or obtaining loans from banks chartered or registered in the state for three years. The judge also increased the authority of a court-appointed financial overseer at the Trump Organization, the main entity for the ex-president’s business activities.

The situation is part of a whirlwind of legal issues Trump is dealing with – including criminal charges in four different cases – but none have lessened his strong position in the race for the Republican nomination. Trump has utilized the cases to energize his supporters and fundraise, claiming that he is being singled out for political motives.

Trump is facing indictment in Washington and Georgia for trying to overturn his 2020 election defeat, and in Florida for mishandling classified documents after his presidency. He has pleaded not guilty in all four cases.
