Taurus Firearms’ Voluntary Recall of Nearly One Million Pistols Raises Safety and Liability Questions

    Published on

In 2015, Taurus, a Brazilian firearms manufacturer, agreed to a landmark voluntary recall of nearly one million pistols, a decision emanating from a class-action lawsuit filed in a federal court in Florida. The lawsuit alleged that nine Taurus models, sold between 1997 and 2013 in the U.S., Puerto Rico, U.S. Virgin Islands, and Guam, contained critical safety system defects that potentially led to inadvertent discharge when jarred or dropped, posing serious risks to users.

The class-action suit was prompted by a harrowing incident involving a sheriff’s deputy, who experienced an accidental discharge of his Taurus pistol, which fell from his holster and fired, striking a nearby vehicle. The lawsuit pointed to various alleged defects in the Taurus pistols’ safety mechanisms, including the firing pin safety block, manual safety latch, and trigger lock mechanism, among others.

As the settlement of the class-action lawsuit awaits finalization, the recall offered different forms of relief to affected owners. However, it notably excludes cases that resulted in personal injury or wrongful death, thereby not providing compensation for such instances. In these cases, claimants are advised to seek legal counsel to potentially recover damages for medical expenses, pain, suffering, and lost income, among other harms.

The recall, while comprehensive, has not been the only safety issue haunting the Taurus brand. A separate class-action lawsuit filed against Taurus in Georgia alleges that GX4 pistols, which have been in production for approximately three years, have a defect that may cause the guns to discharge when dropped. This defect has allegedly resulted in at least one fatality and several nonfatal accidental shootings across different states. Despite awareness of the issue, the manufacturer has not issued a recall for the GX4 pistols, providing only a safety notice on their website and an offer for free inspection and repair for eligible owners.

The litigation history of Taurus, involving multiple models of pistols, raises critical questions about the company’s response to safety defects.

The implications of these recalls and lawsuits extend beyond individual claims and touch on broader issues of corporate responsibility and consumer protection. While the recalls signify an acknowledgment of potential hazards, the lack of proactive measures for all affected models and timely notification to consumers undermines the trust placed in the brand.

For those owning the recalled Taurus pistols or others potentially affected by similar defects, the pathway to compensation and redress involves navigating the complex terrain of product liability litigation. For Taurus, these series of lawsuits serve as stark reminders of the high stakes involved when product safety is compromised, and the importance of maintaining rigorous standards to prevent avoidable harm to users.

As consumers and legal professionals continue to monitor these developments, the unfolding situation underscores the necessity for ongoing diligence and oversight in the firearms industry. It highlights the need for robust safety mechanisms, clear communication with consumers, and swift, transparent action to correct defects that may put lives at risk.
