Former President Donald Trump and eight co-defendants have been granted the opportunity to immediately appeal a decision allowing Fulton County District Attorney Fani Willis to continue overseeing the Georgia election interference case. Fulton County Superior Court Judge Scott McAfee has issued a certificate of immediate review, which permits Trump’s defense team to apply for pretrial review by the Georgia Court of Appeals.
Trump’s lead Georgia attorney, Steve Sadow, underscored the significance of the decision, stating, “It means the defense is permitted to apply to the Georgia Court of Appeals for pretrial review of the Judge’s order refusing to dismiss the case or disqualify Fulton County DA Willis.” Sadow expressed optimism that the appellate review might result in both the dismissal of the case and the disqualification of Willis.
The case in question involves allegations against Trump and his allies for entering a months-long criminal conspiracy to overturn Joe Biden’s 2020 presidential election victory in Georgia. The push for Willis’s disqualification emerged from her once-romantic relationship with Nathan Wade, a special prosecutor who spearheaded the Georgia criminal investigation into Trump. Despite the controversy, Willis was allowed to remain on the case after Wade’s resignation following a judge’s ruling that their relationship presented an “appearance of impropriety.”
McAfee’s order allows the defense to seek appellate consideration of his decision not to disqualify Willis. However, the judge made clear that the proceedings in his court would continue while the appeal is underway. “The Court intends to continue addressing the many other unrelated pending pretrial motions,” McAfee noted, irrespective of whether the petition is granted within the 45-day window post-filing, or if the subsequent appeal is expedited.
The defense team’s argument is rooted in their belief that the relationship between Willis and Wade created an actual conflict of interest, a claim that the district attorney’s office has vehemently denied. The joint motion for permission to appeal emphasized the March 15 Order’s exceptional importance and the potential structural errors it could contain, advocating for prudent and warranted appellate review.
This legal development means the Georgia Court of Appeals has 45 days to decide whether to take on the appeal once it is filed. Should the appellate court agree to hear the case and subsequently opt to disqualify Willis, the prosecution would face significant delays as a new prosecutor would have to be appointed.
The Fulton County District Attorney’s Office, on their part, have committed to advancing the case to trial as expeditiously as possible, with any commentary on the appellate matter reserved for their filings with the Court of Appeals.
