In recent months, Judge Aileen Cannon, appointed by former President Donald Trump, has experienced the abrupt resignation of at least two law clerks—a rare occurrence in the judiciary that has raised eyebrows and prompted speculation. The Southern District of Florida judge has been at the center of the high-profile case involving Trump’s possession of classified documents post-presidency, with proceedings moving at a notably slow pace.

David Lat, a legal analyst and attorney, revealed that these unexpected resignations happened in October and December 2023, times close to when Judge Cannon signaled her openness to delay Trump’s trial beyond the originally set May start date. Lat provided insights into the situation through his Substack and posts on X, stressing the significance of law clerks in a judge’s chambers and the disruption their departures can cause, particularly in busy districts with heavy caseloads.
One clerk reportedly left to raise their child, having departed around halfway through a two-year term. The reasons behind the other clerk’s exit remain shrouded in mystery, and according to Lat, there’s been considerable buzz about the departure among the clerk’s law school classmates. Lat also noted that Judge Cannon’s chambers are now fully staffed, but little else has emerged regarding the circumstances that led to the clerks’ decisions to quit.
Law clerks play a crucial role in supporting a judge’s work, from conducting research to drafting opinions, making such positions highly sought after and typically lasting for a year, due to their value as a credential. It’s unusual for clerks to leave before completing their term, as most would choose to “ride it out” even in less than ideal circumstances, Lat explained. With judges in the Southern District of Florida handling significant caseloads, being short-staffed could quickly lead to backlogs.
“Over the past few days, I have sent multiple emails to the Public Information Office for the Southern District of Florida and to Judge Cannon’s chambers, requesting comment on reports that at least two of her clerks have departed before the scheduled end of their clerkships,” Lat revealed.”I have received read receipts, but no responses .”Without direct comments from the clerks or Judge Cannon, the legal community and public are left with more questions than answers about what exactly prompted these clerks to make the uncommon decision to leave their prestigious positions prematurely.
