    Special Counsel Smith Takes Aim at Judge Cannon’s Jury Instructions in Trump Documents Case

    Special Counsel Jack Smith has sharply criticized Judge Aileen M. Cannon’s handling of the jury instructions in the ongoing criminal case concerning classified documents against former President Donald Trump. In a bold move, Smith filed a searing response to the judge’s request for proposed jury instructions that legal analysts are interpreting as an uncompromising challenge to Cannon’s legal reasoning.

    At the center of the dispute is Cannon’s request for the legal teams to prepare jury instructions based on two hypothetical interpretations of the Presidential Records Act (PRA). One scenario would instruct jurors to determine if the documents Trump kept were personal or presidential records under the PRA. Another would assume that as president, Trump had full authority to retain records, potentially weakening the prosecution’s case.

    Smith contends that the PRA, which distinguishes between personal and presidential records, has “no bearing on whether a former President’s possession of documents containing national defense information is authorized under the Espionage Act,” adding that the PRA “should play no role in the jury instructions.” The Special Counsel expressed frustration that the legal premise of Cannon’s scenarios misrepresents the law’s intentions, a notion echoed by several legal experts who found it unusual for a judge to propose such instructions before the trial date is even set.

    Smith’s team argued that the first jury instruction scenario Cannon proposed had “no proper legal connection” to the case, while the second would effectively present Trump’s PRA defense and direct a verdict against the government. Their filing implored the court to promptly decide on the legal basis of the proposed instructions to ensure that if they are included in error, the prosecution has ample opportunity to seek appellate review before trial. The specter of appeal loomed large in the response, with Smith twice suggesting the possibility of seeking a writ of mandamus from the appeals court, a measure that would compel the judge to correct an assumed error.

    This challenge to the judge’s jurisprudence is rare in its directness. Experts view the filing as an expression of exasperation with Cannon’s interpretation of the law. National security lawyer Bradley Moss noted the unusual nature of this type of communication with a judge. Moreover, the government’s filing detailed evidence countering the notion that Trump designated the disputed documents as personal records, thereby challenging any post hoc justifications for their retention.

    The confrontation between Smith and Cannon arises as the case against Trump remains his most legally tenuous. The Special Counsel has alerted the judge to the seriousness of her possible mistakes, which could lead to discrediting and embarrassing outcomes upon appellate review. The outcome of this issue may depend on Cannon’s reaction to the Special Counsel’s strong criticism and the potential escalation of the case to the 11th Circuit Court of Appeals.

    The key question for observers of the case is whether Smith’s firm stance will prompt a quick resolution of the disputed jury instructions or if additional legal complications will prolong the proceedings as the call for appellate review grows stronger.
