Hunter Biden Convicted on Federal Gun Charges: A First for a President’s Immediate Family Member

    Published on

Hunter Biden, son of President Joe Biden, was convicted on all three federal felony gun charges he faced, marking a notable moment in American political history. The charges, which stemmed from the purchase of a revolver at a Delaware gun shop in October 2018, included two counts of lying about his drug use on a federal background check form and one count of possessing a gun while addicted to, or using, illegal drugs.

The conviction signifies the first instance of an immediate family member of a sitting president being found guilty of a crime during their relative’s term in office, although Hunter Biden’s offenses predated his father’s presidency. After less than three hours of deliberations, the jury delivered a unanimous guilty verdict on all charges.

While Hunter Biden could face up to 25 years in prison and a $750,000 fine, the likelihood of such a harsh sentence is diminished given his status as a first-time offender. Sentencing is expected to be set within 120 days of the verdict. Following the court’s decision, Hunter Biden expressed gratitude for his family’s support and disappointment at the outcome, while his attorney, Abbe Lowell, stated their intention to “vigorously pursue all the legal challenges available to Hunter.”

President Biden’s response to his son’s conviction reaffirmed his dual roles as a father and the president. “Jill and I love our son, and we are so proud of the man he is today,” he said, pledging both love and support for Hunter.

David Weiss, the special counsel, emphasized that the case transcended Hunter Biden’s addiction issues, focusing instead on the “illegal choices” he made while using drugs. “No one is above the law, even the president’s son,” Weiss stated, thanking the jury, prosecutors, and the US attorney general.

Inside the jury room, deliberations initially began with a split, but after careful consideration of the legal standards, the jury reached a unanimous decision on the second day. One juror, speaking to CNN, noted that they felt the trial was a waste of taxpayer dollars, while another expressed that despite the conviction, they did not believe Hunter Biden belonged in jail. The jurors reportedly focused on the evidence and not Hunter Biden’s lifestyle or his family’s political status.

Republican senators reacted to the conviction with a unified voice, asserting that justice had been served and dismissing notions that the verdict indicated any politically motivated prosecution. Sen. Josh Hawley highlighted that the Department of Justice initially considered a plea bargain, suggesting that there was an attempt to avoid prosecution.

Sen. Mitch McConnell, in a Wall Street Journal op-ed, criticized the overreliance on special counsels, like the one used in Hunter Biden’s case, arguing that such practices diminish democratic accountability and suggesting that federal prosecution should remain under elected officials.

The conviction has sparked discussions among both Democratic and Republican lawmakers, with some comparing the case to former President Donald Trump’s recent convictions. Democrats have generally respected the verdict, while some Republicans have questioned the fairness in comparison to Trump’s New York case.

As the political climate buzzes with the implications of Hunter Biden’s conviction, the spotlight on the president’s son is likely to remain intense. His legal struggles continue as he faces a trial in September in California on charges of failing to pay $1.4 million in taxes. Moreover, congressional Republicans signal their intention to persist in their inquiries, while President Biden has made clear that his administration will not intervene.
