In a Delaware courtroom, the stage is set for a trial that could entangle personal vices, digital footprints, and the reach of the law. Hunter Biden, the son of President Joe Biden, is slated to face a jury on June 3, following a pre-trial ruling that permits the introduction of evidence from a laptop he allegedly left at a repair shop and from his memoir, which details his struggle with drug addiction.
The 54-year-old Biden is charged with lying on a form to purchase a gun in October 2018 while addicted to crack cocaine, a charge that could carry up to 25 years in prison if convicted on all counts. Amidst the legal proceedings that US District Judge Maryellen Noreika deemed crucial for the jury’s deliberations, the defense and prosecution prepared to spar over the evidentiary relevance of Biden’s previous drug use and the authenticity of the laptop data.
US District Judge Noreika ruled that the “laptop from hell,” a moniker the device earned amid swirling controversy, is admissible in court. However, she allowed Hunter’s attorneys the opportunity to object to specific pieces of laptop-derived information as they surface during the trial.
Defending the relevance of the laptop contents, prosecutors pointed out that the FBI authenticated the laptop and its contents back in November 2019. The defense, however, retains the right to contest its authenticity and the veracity of the laptop data, which has become a flashpoint of partisan debate and media suppression efforts in previous years.
Notably, Noreika greenlighted the use of a summary chart compiling over 18,000 records from Biden’s iPad and iPhone and excerpts from his 2021 memoir “Beautiful Things,” in which Biden candidly talks about his drug addiction. This approval strengthens the prosecution’s case to show that Biden was involved in drug use when he bought the Colt Cobra .38-caliber revolver.
The judge ruled that the jury cannot hear about Biden’s pending trial on tax evasion charges in California, his Arkansas child support case, or his 2014 discharge from the US Navy Reserve after failing a drug test. And while prosecutors are barred from painting a picture of an “extravagant lifestyle,” they can present evidence of Biden’s spending as it relates to drug procurement.
The defense suggested that store employees may have altered the purchase form after Biden bought the gun. If accurate, this could raise doubts about the validity of the form Biden signed, stating he was not a drug user. Prosecutors minimized the importance of this difference, arguing that the offense was committed when Biden falsely certified his drug use status.
