The investigation into the fake electors plot intended to overturn Joe Biden’s 2020 election win is ramping up in Nevada, with prosecutors securing the cooperation of a key witness.
Kenneth Chesebro, a lawyer who helped orchestrate the fake electors plot across multiple states, has agreed to sit down with Nevada investigators in hopes of avoiding prosecution. Chesebro has already pleaded guilty to a felony in the sprawling case alleging Donald Trump and 18 co-conspirators plotted to overturn the 2020 election results in Georgia, Nevada and five other states.
In late 2020, Chesebro wrote a series of memos spelling out what the pro-Trump electors should do in their respective states. In one memo, Chesebro acknowledged that he was promoting a “controversial strategy” that even the Supreme Court with its conservative supermajority would “likely” reject.
The Nevada Attorney General is investigating the efforts of Republicans who falsely claimed to be Trump electors. In recent weeks, investigators have questioned witnesses about the attempts of the so-called alternate electors to present themselves as viable representatives of the states’ voters. Investigators have also asked about documents those people prepared as part of the effort.
On Dec. 10, 2020, a few days before they would become Nevada fake electors, Michael McDonald, Jim DeGraffenried, and Jesse Law got an email from an attorney named Kenneth Chesebro.“Mayor Giuliani and others with the Trump-Pence campaign,” Chesebro wrote, “asked me to reach out to you and the other Nevada electors to run point on the plan to have all Trump-Pence electors in all six contested States meet and transmit their votes to Congress on Monday, December 14.”
Joe Gloria, who was Clark County registrar of voters told POLITICO that a state investigator asked him questions earlier this month about the fake elector scheme.In Nevada and other states, individuals posing as false electors claimed they were part of a contingency plan due to Trump’s election lawsuits. After the courts rejected the lawsuits, Trump used the false electors to pressure Mike Pence to block the certification of the results on Jan. 6. Chesebro also noted that pro-Trump members of Congress could use the false electors as a reason to overturn the results.
Amy Tarkanian, a former state GOP chairwoman who once supported Donald Trump but now calls MAGA a threat to democracy, said she hopes Nevada joins other states in taking action against the fake electors. “There need to be some repercussions,” said Tarkanian, “so it will make people think very, very hard about trying to pull this kind of garbage off ever again.” She added: “You want to make sure that everyone sees that these people are spreading lies and it’s malicious. And that this is something that could affect the outcomes of future elections, and it has to be stopped.”
