The recent wave of anti-transgender sports bans in several states has sparked a heated debate across the nation. One of the most controversial aspects of these bans is a policy that requires genital examinations of student athletes if their sex is disputed.
This policy, which has been implemented in states like Ohio, mandates that if a player’s sex is challenged, they must present a physician’s statement about their “internal and external reproductive anatomy” and testosterone levels. Students would also have to show an analysis of their genetic makeup.
Critics argue that these requirements are invasive and potentially harmful to the students involved. They also claim that they violate the rights of transgender individuals to participate in sports in a manner consistent with their gender identity.
One of the most vocal critics of these policies is Rep. Alexandria Ocasio-Cortez, who has blasted state policies that force genital examinations on minors. She has referred to these policies as “state-sanctioned bullying” and has called for their immediate reversal.
“Under the guise of not only trying to further marginalize trans women and girls, we are talking about opening up all women and girls to genital examinations when they are underage, potentially just because someone can point to someone and say, ‘I don’t think you’re a girl.’” Ocasio-Cortez stated with great anger.
She also criticized the Biden administration for proposing new rules for transgender student athletes that allow universities and K-12 schools some flexibility to develop team eligibility criteria that serve important educational objectives, such as ensuring fairness in competition or preventing sports-related injury.
Ocasio-Cortez added, “And we’re saying this in an environment of a post-Dobbs America, where states are criminalizing access to abortion and want nothing more than data on women… and we’re supposed to believe that this is going to make us better? And safer? I think not.”
The debate over transgender rights in sports is not limited to Ohio. Similar policies have been proposed and implemented in other states as well. These policies have been met with widespread criticism, with many arguing that they are not only discriminatory but also unnecessary.
According to Equality Ohio and the Ohio High School Athletic Association, there is only one transgender athlete in the entire state who is participating in high school sports. Despite this, the state House Republicans passed a bill known as the “Save Women’s Sports Act,” which bans all transgender students from playing high school and college sports, and requires genital exams in any disputes. The bill is now awaiting approval from the Senate.
