Maine Governor Janet Mills stands firm in the face of violent threats and partisan attacks, signing into law a bill that establishes Maine as a sanctuary state for both transgender individuals seeking gender-affirming care and those seeking abortion services.
The bill, known as LD 227, arrives amid an escalating culture war sweeping the nation, where several states have enacted restrictive laws regarding abortion and transgender healthcare. In a defiant move, the Pine Tree State has codified protections for these groups, ensuring that gender-affirming care and reproductive health care are “legal rights” within its borders.
The LD 227 bill specifically safeguards patients and healthcare providers from legal repercussions stemming from out-of-state actions and prohibits cooperation with external subpoenas and arrest warrants related to services legally provided in Maine. This measure responds to aggressive tactics by attorneys general in states like Tennessee, Indiana, Missouri, and Texas, where attempts have been made to obtain personal healthcare records of transgender individuals. Such cross-state legal assaults have raised significant concerns about the safety and privacy of patients and the autonomy of healthcare systems.
The new Maine law also embeds the World Professional Association of Transgender Health’s Standards of Care within its legislature, a direct counter to misinformation campaigns targeting these protocols. By doing so, Maine legislators have positioned the state as a bulwark against a rising tide of bills elsewhere aimed at curtailing the rights of transgender youth and restricting abortion access.
Supporters and advocates have hailed the bill as a critical step in safeguarding the rights of Maine citizens. Gia Drew, the executive director of EqualityMaine, emphasized the importance of the new law, stating, “We are thrilled to see LD 227, the shield bill, be signed into law by Governor Mills. Thanks to our pro-equality and pro-reproductive choice elected officials who refused to back down in the face of disinformation.”
The controversy surrounding LD 227 has been intense. Prior to its passage, there were bomb threats made against Maine legislators, prompting the evacuation of the state legislature. This alarming occurrence underlines the volatile political climate in which the sanctuary bill was debated and eventually passed.
Despite these challenges, lawmakers bolstered the abortion and gender-affirming care provisions and moved ahead, enacting the legislation. In at least 16 states, gender-affirming care is now specifically safeguarded by state law and shielded from external regulations, offering protection to transgender individuals and abortion seekers as the battle extends beyond state boundaries.
